Terms of Service

These Terms of Service (“Terms”) govern your access to and use of FeelixVibe’s mobile application, websites (including feelixvibe.com), and related services (the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Who may use the Services
You must be at least the age of majority in your jurisdiction (typically 18 years or older) and able to form a binding contract. You may not use the Services if you are prohibited by law.
2. Accounts and security
You are responsible for your account credentials and for activity under your account. Notify us promptly of unauthorized use. We may suspend or terminate accounts that violate these Terms or put the community at risk.
3. Acceptable use
You agree not to:
- Harass, abuse, threaten, defraud, or harm other users.
- Post or share illegal content, non-consensual intimate imagery, hate speech, or content that incites violence.
- Spam, scrape, reverse engineer, or attempt to bypass security or rate limits.
- Misrepresent your identity or create multiple accounts to evade enforcement.
- Use the Services for commercial solicitation in violation of our rules or applicable law.
- Upload malware or attempt to disrupt the Services or other users’ devices.
We may remove content, restrict features, or ban accounts in line with our policies and applicable law.
4. User content
You retain rights to content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, display, and distribute your content solely to operate and improve the Services (e.g. show your profile to matches, deliver messages, moderate for safety, and create backups), subject to your Privacy Policy choices and applicable law. You represent that you have the rights to grant this license.
5. Safety and moderation
We may use automated and human moderation, reporting, blocking, and trust/safety features. We are not obliged to monitor all content and do not guarantee the conduct of other users. Use the in-app report tools for concerns.
6. Paid features and fees
Some features may be paid. Prices, billing, and renewal terms are shown at purchase. Unless required otherwise, fees are non-refundable except as stated in the purchase flow or required by law. You authorize our payment partners to charge your selected payment method.
7. Intellectual property
The Services, branding, and software (excluding your content) are owned by us or our licensors. No rights are granted except the limited right to use the Services under these Terms.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee specific matching outcomes or uninterrupted availability.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) FIFTY U.S. DOLLARS (USD $50) IF NO FEES WERE PAID, UNLESS A DIFFERENT MINIMUM APPLIES IN YOUR JURISDICTION.
10. Indemnity
You will defend, indemnify, and hold harmless FeelixVibe and its affiliates from third-party claims, damages, and costs (including reasonable attorneys’ fees) arising from your content, your use of the Services, or your breach of these Terms, to the extent permitted by law.
11. Termination
You may stop using the Services at any time. We may suspend or terminate access for breach, risk, or legal requirements. Provisions that by nature should survive (e.g. disclaimers, limits, disputes) will survive.
12. Governing law and disputes
These Terms are governed by the laws of the jurisdiction you designate for your operating entity, excluding conflict-of-law rules. For consumers, mandatory local rights may apply. You agree to the courts or arbitration forum you specify with counsel, except where prohibited.

13. Changes
We may update these Terms. We will post the new version and update the “Last updated” date. If changes are material, we will provide additional notice where required. Continued use after changes become effective may constitute acceptance.
